NOTICE TO FINANCIAL INSTITUTIONS & SITE INSPECTORS: This agreement contains specific disclaimers regarding data accuracy, professional reliance, and liability limitations for bank draw verification and industrial site analysis.
AGREEMENT TO OUR LEGAL TERMS
We are Air Capture Productions LLC ("Company," "we," "us," or "our"), a registered business in Washington, United States. We operate the website https://aircapture.me (the "Site"), as well as any related deliverables, 3D models, orthomosaics, and aerial reporting services (collectively, the "Services").

1. OUR SERVICES
Our Services provide high-resolution aerial data, including 3D digital twins and orthomosaic mapping, intended for professional site analysis. You agree to use these Services for lawful business purposes only.
2. INTELLECTUAL PROPERTY RIGHTS
We own all intellectual property in our Services, including source code, website designs, 3D model renderings, and aerial photographs. You are granted a non-exclusive license to access and use these deliverables for your internal business purposes or for submission to authorized third parties (e.g., banks or project stakeholders).
3. PRECISION & DATA ACCURACY
Air Capture Productions LLC utilizes professional-grade photogrammetry equipment. However, we do not warrant that measurements (including volume, distance, or elevation) are 100% accurate for legal land surveying, architectural engineering, or boundary determination. These models are visual representations of site progress and should be verified by a licensed professional where high-precision tolerances are required.
4. USER REPRESENTATIONS
By using the Services, you represent that you have the legal capacity to comply with these terms and are at least 18 years of age.
5. PROHIBITED ACTIVITIES
You may not use the Services for any purpose that is unlawful. Prohibited activities include reverse-engineering 3D model files, attempting to bypass security tokens, or using site data to harass or mislead third parties.
6. THIRD-PARTY WEBSITES AND CONTENT
Our interactive maps utilize third-party providers including Cesium Ion, Mapbox, and Netlify. We are not responsible for the uptime or accuracy of underlying satellite imagery or terrain data provided by these third parties.
7. SERVICES MANAGEMENT
We reserve the right to monitor the Services for violations, to take legal action against violators, and to manage the Services in a manner designed to protect our rights and property.
8. PRIVACY POLICY
Your privacy is important. Please review our Privacy Policy at privacy.html. By using the Services, you agree to be bound by our Privacy Policy.
9. TERM AND TERMINATION
These Legal Terms remain in full force while you use the Services. We reserve the right to, in our sole discretion and without notice, deny access to and use of the Services to any person for any reason.
10. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change or remove content at any time. We are not liable for service interruptions caused by maintenance or third-party cloud hosting issues.
11. GOVERNING LAW
These Legal Terms are governed by the laws of the State of Washington. Any legal action shall be commenced in the courts located in Stevens County, Washington.
12. DISPUTE RESOLUTION
Any dispute arising under this agreement shall be subject to the exclusive jurisdiction of the state and federal courts in Stevens County, Washington.
13. SERVICE DISCLAIMER
THE SERVICES ARE PROVIDED "AS IS." CONTENT DOES NOT CONSTITUTE ENGINEERING, LEGAL, OR FINANCIAL ADVICE. AIR CAPTURE PRODUCTIONS LLC DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW. USERS ASSUME ALL RISK FOR ACTIONS TAKEN BASED ON SITE PROGRESS DATA OR 3D MODELS.
14. LIMITATIONS OF LIABILITY
IN NO EVENT WILL AIR CAPTURE PRODUCTIONS LLC BE LIABLE FOR FINANCIAL LOSSES, CONSTRUCTION DELAYS, OR "MISSED DRAWS" RESULTING FROM THE USE OF OUR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE PROVIDED.
15. INDEMNIFICATION
You agree to defend, indemnify, and hold Air Capture Productions LLC harmless from any claims arising out of your breach of these Legal Terms or your use of the Services.
